    Kylie Sharp is a senior lawyer in Aughtersons’ Wills and Estates team with over 12 years of extensive experience.

    Whilst Kylie’s focus is on wills and estates, she also has considerable experience in commercial law and litigation.  Kylie has conducted litigation in all Victorian Courts and tribunals and the Federal Court of Australia.

    Kylie is personable and clients appreciate her caring approach and patience in explaining legal processes and concepts, together with her passion to resolve disputes as efficiently as possible to achieve the best outcome for clients.

    Kylie is able to assist in all aspects of wills and estates including:

    Estate Litigation:
    • Applications for further provision from estates;
    • Challenges to Will validity, including on the grounds of lack of testamentary capacity and undue influence;
    • Applications to remove executors;
    • Applications to recover misappropriated assets from an estate;
    • Statutory Will Applications;
    • Applications for judicial advice regarding the administration of an estate.

    Probate and Estate Administration:
    • Acting for executors/administrators in applying for grants of representation including complex applications in relation to informal Wills;
    • Obtaining Victorian reseals of foreign/interstate grants of probate;
    • Estate administration including advice regarding executor/ administrator duties and obligations;
    • Preparing deeds of family arrangement;
    • Advice in relation to life interests;
    • Advice in relation to insolvent estates.

    Guardianship and Administration:
    • Appearing in VCAT Guardianship and Administration list in relation to disputes regarding the affairs of a living person including disputes regarding financial powers of attorney, financial administration and accommodation;
    • Acting in power of attorney disputes, including the misappropriation of funds.

    Estate Planning:
    • Preparing Wills and Enduring Powers of Attorney, including complex testamentary trusts;
    • Advising in relation to minimise the risk of claims against the estate;
    • Advising in relation to estate planning for complex family relationships.
